Divorce
Separation and divorce can be traumatic and stressful. With heightened emotions, anger, sadness and so on, rational and reasonable behaviour is often in short supply.
There are three main components in family proceedings; divorce, children and finance. Divorce is invariably the most straightforward, though it can only be achieved by applying to the court and making a petition which sets out the reasons why the marriage has broken down.
In England and Wales, the court will only grant a divorce when it is satisfied that one condition is met; that the 'marriage has broken down irretrievably.
It may be possible to resolve matters concerning children and finances outside of court. I can assist you in achieving a good outcome and where possible, try to avoid having to go to court. Where this is not possible with regards to children and finance matters, I can guide you and help to ensure that you as well prepared as you can be for court. It is almost always preferable to reach agreements without having to involve the courts and these agreements often stand a better chance of 'sticking' if the parties can reach agreement themselves. However, help is at hand if you need to apply to the court to move these matters forwards and cannot reach agreement with your 'ex'.
My role in your divorce proceedings is to set out your options and help you decide the best and most appropriate course of action for you and your circumstances. I can also assist you in preparing your application and petition. It is unlikely that you will need to attend court in person for divorce proceedings (i.e. to dissolve the marriage) as almost all divorces are achieved 'on paper'.
